Cyber Law in Australia

Cyber law covers everything from privacy and data breaches to online scams, harassment and computer offences. Most matters are handled by the Australian Cyber Security Centre, the Office of the Australian Information Commissioner, and the eSafety Commissioner.

Reporting cybercrime

ReportCyber (cyber.gov.au) is the official portal to report cybercrime to police. For scams that did not result in a crime — such as suspicious messages — use Scamwatch operated by the ACCC. If a child is in immediate danger, call 000.

Privacy and your data

The Privacy Act 1988 (Cth) sets out the Australian Privacy Principles. Most organisations with annual turnover over $3 million must comply. The OAIC handles complaints about how your personal information has been collected, used or disclosed.

Online safety and harassment

The Online Safety Act 2021 gives the eSafety Commissioner powers to require removal of cyberbullying content targeted at children, image-based abuse and seriously harmful adult content. You can lodge a complaint directly with eSafety.

Computer offences

Unauthorised access, modification or impairment of computer systems is criminal under Part 10.7 of the Commonwealth Criminal Code. State laws also apply.
